Heard the learned counsel appearing for the parties. 3. FIR in Crime No.483/24 was registered by Soladevanahally Police Station, Bengaluru City against the petitioner herein and others for the aforesaid offences, on the basis of first information dated 19.12.2024 received from Sri Raja G.C, police officer, attached to Soladevanahally Police Station. During the course of investigation of the case, the petitioner herein was - 3 - NC: 2025:KHC:10716 CRL.P No. 2841 of 2025 arrested on 19.12.2024 and subsequently remanded to judicial custody. 4. The bail application filed by the petitioner before the jurisdictional Sessions Court in Crl.Misc.No.36/2025 was dismissed on 16.01.2025. Therefore, he is before this Court. 5. Perusal of the materials on record would go to show that, from the house of accused Nos.2 and 3 during the course of raid, the police had rescued one victim. Therefore, offence punishable under Section 143(3) of BNS, 2023 may not be prima-facie applicable in the present case. The maximum punishment for the offence punishable under Section 143(2) of BNS, 2023 is imprisonment for a period of seven years. It is not in dispute that the petitioner has no other criminal antecedents. Learned counsel for the petitioner has brought to the notice of this Court that investigation in the case is complete and charge sheet has been filed. Under these circumstances, I am of the opinion that, the prayer - 4 - NC: 2025:KHC:10716 CRL.P No. 2841 of 2025 made by the petitioner for grant of regular bail needs to be answered affirmatively. 6. Accordingly, the following: ORDER The petitioner is directed to be enlarged on bail in Crime No.483/24 registered by Soladevanahally Police Station, Bengaluru City for the offences punishable under Sections 143(2) & 143(3) of BNS, 2023 and Sections 3, 4 & 5 of the Immoral Traffic Prevention Act, 1956, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000 (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; - 5 - NC: 2025:KHC:10716 CRL.P No. 2841 of 2025 c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; Sd/- (S VISHWAJITH SHETTY) JUDGE NMS
