2 / 3 Mohla-Manpur-Ambagarh Chowki, is seeking a direction towards the respondent authorities to consider the case of the petitioner for grant of proper pay scale i.e. Rs. 9300-34800-4200.

Learned counsel appearing for the petitioner would submit that the petitioner is working as Election Supervisor in the District Election Office, Mohla and was appointed vide order dated 01/09/2023 by the Office of Collector and District Election Officer. He submits that though the petitioner was appointed on the pay scale of Rs.9300-34800 but till date, the proper pay has not been fixed and the petitioner is not receiving the pay as mentioned in the appointment order. By referring the communication dated 07/01/2025 issued by the Office of Chief Election Officer, he submits that the Assistant Chief Election Officer has also requested to the Collector for fixing the pay of the petitioner in the pay scale of Rs. 9300-34800. Learned counsel would further submit that the petitioner has also submitted representation to the Collector on 09/03/2025, however, till date neither the representation has been decided nor the payment is being fixed on the pay scale on which the petitioner has been appointed.

Learned counsel appearing for the State would submit that if the representation submitted by the petitioner is still pending before the Collector, the same shall be considered in accordance with law and necessary steps shall be taken for grant of proper pay to the petitioner, within the stipulated time.

4. I have heard learned counsel for the parties and perused the documents.

In view of the aforesaid submission made by counsel for the State and considering the fact that the Assistant Chief Election Officer vide its communication dated 07/01/2025 has requested the Collector for fixing the pay of the petitioner on the pay scale of Rs. 9300-34800 Grade pay Rs. 4200, the respondent No.3/ Collector is directed to consider the case of the petitioner within a period of 50 days from the date of receipt of a copy of this order and take necessary steps for fixing the proper pay of the petitioner in accordance with law and the communication of the Assistant Chief Commissioner, if he is entitled according to his appointment
order.
