For the State : Mr. Ajay Kumar Pathak, A.P.P. For the Informant : Mr. Soumitra Baroi, Advocate ----- 10/ 11.06.2025 Heard the parties. 2. This anticipatory bail application under Section 438 and 440 of Code of Criminal Procedure, has been preferred by the petitioner apprehending his arrest for offences registered under Sections 406, 420, 467, 468, 120B and 34 of the Indian Penal Code. 3. Learned A.P.P. representing the State opposes the prayer for grant of anticipatory bail. 4. The allegation against the petitioner is that he has forged and prepared a WILL alleging to be prepared by the deceased husband of the informant. 5. During course of argument it has come to the notice of this Court that the WILL is not a registered WILL and the same is just notarized. Further it has come to the notice that no proceeding for probate has been initiated for probate of the WILL. Thus, the WILL is nothing but a piece of paper without any value and cannot be acted upon. The question of forging of WILL can also be raised in a proceeding if the WILL is sought to be probated. 6. Considering the aforesaid position, this Court finds it a fit case for grant of anticipatory bail to the petitioner. 2025:JHHC:15040 2
