Heard learned counsel for the applicant as also the learned A.G.A. for the State and perused the record. The instant application under Section 483 Cr.P.C. has been filed by the applicant with the prayer to direct the Court of the Learned Additional Sessions Judge, Court No.-2, Pratapgarh to decide Sessions Trial No.-281 of 2015 (State vs. Hazrat Ali and Others) arising out of Charge-Sheet No.106 of 2004 dated 31.06.2004, in pursuance of Case Crime No.-106 of 2004 under Sections 147, 148, 149, 302 I.P.C., Police Station Mandhata, District Pratapgarh, within a time-bound period. It has been submitted by learned counsel for the applicant that the trial is pending since 2004. More than 21 years have passed and formal witnesses are yet to be examined, therefore, the trial court may be directed to expedite the trial. Learned A.G.A. has no objection to the limited prayer made by the learned counsel for the applicant being granted. In view of the above, the trial court concerned is directed to decide the aforesaid Sessions Trial No.-281 of 2015 (State vs. Hazrat Ali and Others) expeditiously by taking necessary Versus Counsel for Applicant(s) : Sumit Kumar Counsel for Opposite Party(s) : G.A.
