Order 20/05/2025
Learned counsel for the petitioner submits that petitioner is in possession of land in question since time of his forefathers. It is submitted that against action of respondents, a civil suit was filed by the petitioner wherein vide order dated 27.03.2025, it was
directed that petitioner shall not be dispossessed from the property in question without following due process of law. It is submitted that thereafter, two notices were issued upon the
[2025:RJ-JP:21319] (2 of 2) [CW-7520/2025] petitioner on 01.04.2025 & 17.04.2025. Both notices have been replied by the petitioner but without considering the submissions and averments made by petitioner in those replies, respondents are hell bent upon to dispossess the petitioner. Learned counsel contends that it is reasonable expectation from the respondents to pass a reasoned order on the reply/representation submitted by the petitioner and petitioner should be made aware about fate of said reply/representation. Considering the aforesaid facts and circumstances of the case and further considering the fact that issue is pending before learned Civil Court, I deem it just and proper to dispose of this writ petition with direction to the respondents to pass a reasoned
order on the reply/representation filed by the petitioner within a period of two weeks from today. It is further observed that respondents will intimate the petitioner about fate of the representation by proper means. In case, representation of the petitioner is rejected, before taking any coercive action, the petitioner may be granted at least four weeks time to avail legal remedy in accordance with law. Till decision on the representation, respondent authorities are directed to maintain status quo with regard to property in question. With the aforesaid directions, this writ petition is disposed of.
