2. Case of the prosecution, in brief, is that on 26.10.2024, OfÏcers of Police has received the secrete information from the informant with the averment that the applicant kept the liquor for the purpose of selling so the police ofÏcers have made the search and alleged to be seized about 25.200 bulk liters country made liquor, therefore, arrested the present applicant on the basis of doubt. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. He further submits that the applicant has two previous criminal antecedents under the Excise Act, out of which one case is disposed of and another one case is pending. The same has been explained in paragraph No. 4(a) of this bail application. He also submits that the charge-sheet has been filed in the present case and the applicant is in jail since 26.10.2024. It is further argued by him that under Section 34(2) of the C.G. Excise Act, minimum punishment is one year and maximum punishment is three years and the conclusion of the trial is likely to take quite long time. Therefore, he prays for grant of regular bail to the applicant. 4. Learned counsel for the State/non-applicant opposes the bail application. He further submits that total 25.200 bulk liters country made liquor seized from the possession of the present applicant and further the applicant has two previous criminal antecedents under the Excise Act and the charge-sheet has been filed, therefore, he is not entitled for grant of bail. 5.
I have heard learned counsel appearing for the parties and perused the case diary. 3
