HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 12822 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Heard learned counsel for the applicant as well as learned A.G.A. and perused the record. 2. The applicant seeks enlargement on bail in FIR No.182 of 2025, under Section 85, 80(2) of BNS and Section 3/4 of D.P. Act, Police Station Shivgarh, District Raebareli. 3. It is argued by the Counsel for the applicant that the co-accused have been enlarged on bail vide separate orders. My attention is drawn to the statement of the informant, wherein, he stated that the applicant was not even present on the date of the incident. The cause of death as per the postmortem report is electrocution. 4. Learned A.G.A. vehemently opposed the bail prayer. 5. Considering the statement of the informant, which is on record at page 33 of the bail application and there being nothing against the applicant to suggest that soon before her death, the victim was subjected to any physical or mental harassment in relation to any demand of dowry coupled with the fact that the applicant has no criminal antecedents and is languishing in jail since 14.08.2025, I am of the view that the applicant is entitled to be released on bail. Accordingly, the bail application is allowed . 6. Let the applicant Satish Kumar Chaturvedi @ Gorelal be released on Versus Counsel for Applicant(s) : Jaikaran Counsel for Opposite Party(s) : G.A.
