Heard learned counsel for the applicants, learned A.G.A. for the State and perused the record. 2. The present application has been filed for getting a direction issued to the court of Additional Chief Judicial Magistrate-IVth, Court no.28, District Lucknow, to decide the application under Rule 6(5) of the Protection of Women from Domestic Violence Rules, 2006 and thereafter complaint under Section 12 of the Protection of Women from Domestic Violence Act, 2005, bearing Complaint Case No.899 of 2017 (Smt. Asma Yasmeen and another vs. Mohammad Yasir Siddiqui and others), expeditiously in accordance with law. 3. Learned counsel for the applicants has submitted that the proceedings under Section 12 of the Domestic Violence Act, is pending since 2017, whereas Section 12(5) of the said Act, provides that a case under the Domestic Violence Act, shall be decided within a period of sixty days. 4. In view of the aforesaid fact, the concerned court i.e. court of Additional Chief Judicial Magistrate-IVth, Court no.28, District Versus Counsel for Applicant(s) : Mohd. Muballi Gussalam, Mohd. Khalid Amin Khan Counsel for Opposite Party(s) : Smt. Asma Yasmin And Another .....Applicant(s) Mohammad Yasir Siddiqui And 5 Others .....Opposite Party(s) Lucknow, is directed to adhere to the provisions of Section 12(5) of the Domestic Violence Act and accordingly take a decision in the matter, expeditiously, in accordance with law, after affording opportunity of hearing to both the parties and without granting any unnecessary adjournments. 5.
