By means of this petition, the petitioners have sought quashing of F.I.R. dated 05.12.2023, bearing Case Crime/FIR No.54/2023, for the offence under Sections 498-A, 323, 313, 377 I.P.C. and Section 3, 4 of D.P. Act, registered at Police Station Mahila Thana, District Barabanki. Let notice be issued to opposite party No.3. Let the pleadings be exchanged within eight weeks. List thereafter. Considering the submission of petitioners' counsel that the marriage between the petitioner No.1 and the opposite party No.3 was solemnized in 2020, but the F.I.R. has been lodged only on 05.12.2023, that too after the petitioner No.1 had divorced the informant, out of malice, just to harass the petitioner No.1 and his family members and as all the family members have been roped in including the married sisters, who live separately, it is provided that the petitioners shall not be arrested on the basis of the impugned First Information Report. However, they shall co-operate in the investigation, which shall go on, and they shall get their statement recorded before the Police as and when they are called". 4.
