GP FOR REVENUE The Court made the following: 2 THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO: 13087/2025 ORDER: This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:- “to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the Form-Ill notice dated 27.03.2025 issued by the respondent No.4 under Rule 3 of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Rules, 2007 as illegal and arbitrary, without jurisdiction and consequently set aside the Form-Ill notice dated 27.03.2025 issued by the respondent No.4 and pass such other order.” 2. Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents. 3. Learned counsel for the petitioner submits that the petitioner’s wife purchased the land admeasuring to an extent of Ac.3.69 cents in Sy.No.437/A3, Gajulapalli Village, Mahanandi Mandal, Nandyal District through a registered sale deed dated 01.09.2021. Subsequently, the petitioner’s wife bequeathed the said property in favour of the petitioner by way of a gift deed dated 21.03.2024. Since, then the petitioner has been in peaceful possession and enjoyment of the subject property. While things stood thus, to the utter surprise of the petitioner, the respondents issued Form-I notice dated 27.03.2025 to the petitioner alleging that the subject land is an assigned land. For which, the petitioner 3 submitted his explanation dated 11.04.2025, but the respondents did not consider the same. Hence, the Writ Petition. 4. Learned Government Pleader for the respondents submits that since the petitioner submitted his explanation dated 11.04.2025, the respondents will consider the same and pass appropriate orders, within a reasonable time. 5. Having regard to the submissions made by the learned counsel for the petitioner and the learned Government Pleader for the respondents, this Court deems it appropriate to dispose of the Writ Petition directing the respondents to consider and dispose of the explanation dated 11.04.2025 submitted by the petitioner pursuant to the notice dated 27.03.2025, within a period of three(3) months from the date of receipt of copy of this Order. Till then, status-quo obtaining as on today shall be maintained by all the parties concerned. 6. With the above direction, the writ petition is disposed of. There shall be no order as to costs.
