The petitioner is a complainant and he made a complaint against the sitting Pradhan of the village respondent no.4 namely Suchita Devi since no action has been taken on the same, petitioner has preferred present writ petition. 2. Pursuant to the order passed by this Court instructions dated 07.05.2025 under signature of District Panchayat Raj Officer, Varanasi was placed before the Court, same is taken on record. 3. It is stated in paragraph-3 of the aforesaid instructions that Enquiry Officer has submitted his enquiry report dated 07.05.2025 in which certain irregularities were found against the respondent no.4 and enquiry against the respondent no.4 under Section 95(1) (g) of U.P. Panchayat Raj Act, 1947 is pending consideration. 4. On the other hand it is argued by learned Standing Counsel that the decision will be taken by the authority concerned expeditiously. 5. With the consent of learned counsel for the parties, the writ petition is being disposed of at the admission stage itself. 6. In the facts and circumstances of the case, the present petition is disposed of directing the respondent no.2-District Magistrate, Varanasi to take a final decision on the complaint made by the petitioner strictly in accordance with law most expeditiously and positively within a period of two months after providing opportunity of hearing to the parties concerned and in view of the procedure prescribed under U.P. Panchayat Raj (Removal of Pradhan, Up-Pradhan and Members) Enquiry Rules, 1997.
