Heard learned counsel for the petitioner, learned Standing Counsel appearing for the State-respondent and Sri Vinay Shanker, learned counsel appearing for the Bank. 2. It has been contended on behalf of the petitioner that due to some cyber fraud, certain amount was debited from the petitioner's saving bank account and in that regard a complaint was lodged by him in the Cyber Crime Cell of the police. The police have temporarily frozen the operation of the petitioner's saving bank account and thereafter certain amount which were debited, have been returned in his saving bank account. Learned counsel appearing on behalf of the petitioner submits that since the year 2024 account of the petitioner is in frozen condition and he is not able to operate the same. 3. We have considered the submissions made by learned counsel appearing for the parties and we find it difficult to comprehend as to how the petitioner' account was frozen by the Cyber Cell of the Police whereas the petitioner himself is a victim of the cyber fraud. 4. In view of the aforesaid reason, we hereby direct the bank authorities to allow the petitioner to operate his saving bank Versus Counsel for Petitioner(s) : Ashok Kumar, Chandra Prakash, Vimal Kumar Counsel for Respondent(s) : C.S.C. Atul Kumar .....Petitioner(s) State Of U.P. Thru Prin.Secy.
