HIGH COURT OF JUDICATURE AT ALLAHABAD APPLICATION U/S 528 BNSS No. - 4732 of 2025 Court No. - 74 HON'BLE SANJAY KUMAR PACHORI, J. Sri Prabhat Chandra Mishra, learned counsel for the applicant, Sri Amit Daga, learned counsel for the opposite party no. 2 and Sri Alok Mishra learned A.G.A. for the State are present. The present application under Section 528 of Bharatiya Nagarik Suraksha Sanhita has been filed to quash the entire proceedings of Complaint Case No. 285 of 2024, (New Case No. 743 of 2024), as well as cognizance/ summoning order dated 19.01.2024 by which the learned Magistrate took cognizance under Sections 420, 467, 468, 471, 120-B of I.P.C., Police Station- Civil Line, District Etawah, pending in the court of Chief Judicial Magistrate, Etawah. The matter is distinguishable with the co-accused Sita Ram and Prateek passed by this Court in Application U/S 482 No. 27034 of 2024 on 14.11.2024. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof. In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
