2. This is an application under Section 483 BNSS, 2023 praying for grant of bail to the accused/petitioner Sri. Kukan Dey in connection with Simaluguri PS Case No. 24/2024 under Section 384/506 of the IPC R/W Sections 10/13/17/18 of the UA(P) Act, 1967.

The facts of the case is that present FIR was lodged by one Sri Kapil Bakal, alleging inter alia that on 26.05.2023 he received a message through WhatsApp from mobile number 8837338980 purportedly from the banned ULFA-I organization, signed by one Ganesh Axom, demanding an amount of Rs.15,00,000/- from him. It has further been alleged that despite informing the authorities, the extortionists continued to threaten him and on 27.09.2024, he received a threatening phone call from mobile number 8822747983, warning him of dire consequences in case of non-payment of the demanded amount. The caller allegedly claimed to have an extensive network across Assam, particularly in Sivasagar, and cautioned the informant that he would regret his failure to comply with their demands. It is also stated that the informant pleaded his inability to pay owing to financial and health issues, but the threats persisted, including video calls through WhatsApp, recordings of which were allegedly shared with the concerned authorities. Based on these allegations, the FIR came to be registered against unknown persons. Hence, the case.
4. The maximum period of statutory detention under the aforesaid provisions of law is 90 days, unless extended. Mr. B Sarma, learned Additional Public Prosecutor for the State of Assam, on instructions received has submitted that no prayer for extension was made nor any
order of extension has been passed. In the meantime, the petitioner has completed the statutory period of 90 days and accordingly he is

5. Accordingly, the prayer for bail is allowed. The accused/petitioner Sri. Kukan Dey is allowed to go on bail of Rs. 50,000/- with 2(two) sureties of the like amount to the satisfaction of the Ld. Trial Court under the following conditions : (i) The petitioner shall cooperate with the investigation and appear before the I/O as and when called for. (ii) The petitioner shall not tamper with the evidence or influence the witnesses connected with the case. (iii) The petitioner shall not leave his place of residence without the permission of the Ld. Trial Court.
6. Accordingly, the petition stands allowed and disposed of.
