1. Heard Mr. N. Nath, learned counsel for the petitioners. Also heard Ms. S.H. Bora, learned Additional Public Prosecutor for the State.
2. By this application, the petitioners have prayed for pre-arrest bail in connection with Bhangagarh P.S Case No. 90/2025 registered under Section 61(2)/318(4)/336(3)/340(1)/316(5) of B.N.S, 2023.
3. Vide order dated 28.08.2025, the three petitioners were granted interim bail with conditions and for the reasons noted in para 6 and 7 of the order. It is submitted that pursuant thereof, the petitioners have appeared and their statements were recorded and the same is confirmed by the learned Additional Public Prosecutor for the State.
4. The learned Additional Public Prosecutor for the State further submits that from the statements of petitioner nos.1 and 2, it is revealed that in the concerned matter, they conducted themselves with gross carelessness and therefore, the prosecution has some objections to the grant of bail.
5. It is pointed out by the earned Additional Public Prosecutor
Page No.# 3/3 for the State that in the order of interim bail, it was directed that there will be one local surety and the petitioner’s side has submitted that this condition has been complied with.
6. In the given circumstances, I do not deem it necessary to cancel the interim bail and accordingly, the interim bail granted vide
order dated 28.08.2025 is hereby made absolute subject to the conditions : i) That the petitioners shall co-operate with the remaining investigation; ii) That the petitioners shall not hamper or tamper with evidence or try to influence witnesses; otherwise co-operate with the process of law.
7. Return back the case diary.
8. Accordingly, this anticipatory bail petition is allowed and
disposed of.
