ORAL ORDER
1. Gowramma submitted a petition to the Inquiry officer requesting that an inquiry be conducted and her name be entered in the survey records.

2. This request was accepted by the Inquiry Officer by his order dated 25.04.2011.
3. The petitioner herein being aggrieved by the said
order preferred a revision under Section 56 of the Karnataka Land Revenue Act, 1964 (for short, 'the Act') to the Joint Director of Land Records (for short, 'the JDLR'). The JDLR has by the impugned order dated 14.06.2012 dismissed the revision.
4. As a consequence, the petitioner is before this Court by way of this writ petition.
5. It is the contention of the learned counsel appearing for the petitioner-Central Government that the order of the JDLR cannot be sustained, since the JDLR has given absolutely no reasons and he has merely reiterated the contentions advanced by both the parties.
6. He submits that since the impugned order is passed without assigning any reasons for either accepting or

rejecting the claim of either of the parties, the said
order cannot be sustained.
7. A perusal of the impugned order would indicate that the JDLR has merely reiterated all the contentions advanced by both the parties and the ultimate
reasoning given by him is in paragraph Nos.24, 25 and 26, which read as follows:

8. As could be seen from the above, the JDLR has given absolutely no reasons for either agreeing with the respondents or disagreeing with the petitioner. He has merely stated that on the basis of the documents submitted and the arguments advanced, he was satisfied that the petitioner herein has not substantiated its contentions and therefore, the revision was required to be dismissed. - 6 -

9. In my view, such an order which does not consider any of the contentions and does not record any finding regarding the contentions advanced by both the parties cannot be sustained. 10. Consequently, the impugned order dated 14.06.2012 at Annexure 'K' passed by the JDLR is set aside and as a further consequence, the matter is remanded to the JDLR with the direction to the JDLR to consider all the contentions advanced by both the parties and record a specific finding as to why the contentions of either parties should or should not be accepted. 11. The writ petition is accordingly allowed. 12. Since both the parties are represented by their counsels in this writ petition, they are directed to appear before the JDLR on 29.04.2025 without expecting any further notice from him. 13.
Having regard to the fact that the matter is of the year 2011, the JDLR is directed to dispose of the

revision within a period of four months from
29.04.2025. 14. It is needless to state that all contentions of either of the parties are left open. 15. In view of the disposal of the petition, all pending interlocutory applications, if any, stand disposed of. Sd/- (N S SANJAY GOWDA) JUDGE
