1. Heard learned counsel for the applicant as well as learned A.G.A. and perused the record. No one appears on behalf of the complainant, despite service of notice. 2. The applicant seeks enlargement on bail in FIR No.660 of 2022, under Section 376DA IPC and Section 5G/6 of POCSO Act, Police station Mohammadi, District Lakhimpur Kheri. 3. It is argued by the Counsel for the applicant that on the same allegation, the co-accused Nikhil alias Nikhil Kumar has been enlarged on bail by this Court vide order dated 28.08.2024 passed in Criminal Misc. Bail Application No.5494 of 2024. 4. Learned A.G.A. vehemently opposed the bail prayer. 5. Considering the fact that the allegations against the applicant to be similar to the co-accused, who has been enlarged on bail and adopting the same reasoning contained in the order dated 28.08.2024 coupled with the fact that the applicant has no criminal antecedents and is languishing in jail since 11.09.2022, I am of the view that the applicant is entitled to be released on bail on the ground of parity. Accordingly, the bail application is allowed. 6.
