1. Heard Mr. K. R. Patgiri, learned counsel for the appellant. Also heard Mr. S. Deka, learned counsel for the respondent Nos. 1 to 7.
2. The learned counsel for the appellant has submitted that he has received instructions from the appellant to withdraw the instant Regular Second Appeal and accordingly he seeks leave of this Court to do so. In support of his submissions, he has furnished an affidavit sworn in by the appellant, namely, Hanta Buragohain wherein it is stated that the appellant no longer intends to pursue the instant Regular Second Appeal.
3. Considering the submissions made by the learned counsel for the appellant, the prayer is allowed.
4. This appeal is dismissed on withdrawal.
5. Let the affidavit furnished by the learned counsel for the appellant marked as “X” be kept in the record of the instant appeal as part of it.
