HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 10153 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J.
1. Heard learned counsel for the applicant as well as learned A.G.A for the State and perused the record. 2. The present application has been filed with the prayer to enlarged the applicant on bail in Case Crime No.35 of 2025, under Sections 318(4), 317(2) of BNS, P.S.- Manak Nagar, District- Lucknow. 3. In the prosecution case, it is alleged that on 27.05.2025, at about 10-11 A.M, the informant went to withdraw money from the ATM situated in front of the Manak Nagar, but his ATM Card got stuck in the machine. He went to the Singar Nagar branch but he could not find any person to contact, so he returned to the ATM and found some other card in place of his card and also found that Rs.1 lakh had been withdrawn from his account. 4. Learned counsel for the applicant submits that there is no material against the applicant except for his confessional statement. False recovery of Rs.6500, items used to tamper ATM machines, ATM cards and mobile phones have been made for which there is no independent witness. He further submits that the applicant has explained criminal history of 20 cases in paragraph-17 of the bail application and he is languishing in jail since
31.07.2025. 5. It is further submitted that there is no possibility of the applicant of fleeing away after being released from jail or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail. 6. Learned A.G.A. opposed the prayer for bail but could not dispute the aforesaid facts as argued by the learned counsel for the applicant. Versus Counsel for Applicant(s) : Jaikaran Counsel for Opposite Party(s) : G.A. Ranjeet Yadav .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Lko. .....Opposite Party(s)
7.
Considering the facts and circumstances of the case, and also considering the nature of allegations, arguments advanced by learned counsel for the parties, as also the period for which the applicant is in jail i.e. since 31.07.2025; as also the fact that the applicant has explained criminal history of 20 cases in paragraph-17 of the bail application, the fact that there is no independent witness of the said recovery, the fact that the offences are triable by the Magistrate and the charge-sheet has been filed, thus, without expressing any opinion on the merits of the case, I find it to be a fit case for enlarging the applicant on bail. 8. Accordingly, the bail application is allowed. 9. Let the applicant Ranjeet Yadav, involved in Case Crime/FIR No. 35 of 2025, Under Sections- 318(4), 317(2) B.N.S., Police Station- Manak Nagar, District- Lucknow, be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions which are being imposed in the interest of justice:- (i) The applicant will not tamper with the evidence during the trial.
