GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the inaction on the part of respondents 2 to 6 on petitioners' representations dated 14.08.2020 and 29.08.2020 submitted for granting police aid for cultivation of petitioners' landed properties admeasuring Ac.4.33 cents covered by Survey No.429/5 of Tadikalapudi Revenue Village in Kamavarapukota Mandal of West Godavari District, in view of decree for permanent injunction dated 20.08.2015 granted in favour of petitioners in O.S.No. 58/2009 on the file of learnt Junior Civil Judge, Chintalapudi, as illegal, irregular, irrational and amounts to non discharge of legal obligation conferred on respondents 2 to 6 under the provisions of the Code of Criminal Procedure, 1973 and offends Articles 14 and 21 of Constitution of India and consequently direct the respondents to grant necessary police aid for cultivation of petitioners' said lands.” 2. Sri V.Farooq, learned Assistant Government Pleader for Home, would submit that, the matter is of civil nature and the Police cannot interfere in the civil disputes between the parties. 3. Ms.Nimmagadda Revathi, learned counsel for the Petitioners would submit that, in view of the decree of permanent injunction granted in favour of the Petitioners in O.S.No.58 of 2009 on the file of the Court of Junior Civil 3 Judge, Chintalapudi, the Respondents may be directed to consider the representation of the Petitioners for providing police aid. 4. Considering the submissions made, the Writ Petition is disposed of directing the Respondents–Police to consider the representation of the Petitioner and take appropriate course of action according to governing rules and law. There shall be no order as to costs.
