This application has been preferred by the appellant for condoning a delay of 13 days in filing the appeal. Having been satisfied with the reasons assigned in the instant application, the same is allowed and a delay of 13 days in filling the appeal is hereby condoned. I.A. No. 8017 of 2025 stands disposed of. Cr. Appeal (DB) No. 725 of 2025. This appeal is directed against the order dated 22.04.2025 passed by the learned Additional Sessions Judge-I, Seraikella in M.C.R.A. No. 506/2025 in connection with Kuchai P.S. Case No. 33/2019, whereby and whereunder, the prayer for bail of the appellant has been rejected. It has been alleged that there was an exchange of firing between the extremists and the Police personnel but subsequently on being outmaneuvered, the extremists had fled away. On a search of the place of occurrence, several arms and ammunitions and other incriminating materials were recovered. Submission has been advanced by the learned counsel for the appellant that the appellant is not named in the FIR and has been implicated on the confessional statement of

the co-accused. It has been submitted that the appellant is in custody since 06.02.2024. Learned A.P.P. has opposed the prayer for bail of the appellant and submitted that the appellant has got criminal antecedent.
Regard being had to the manner of implication of the appellant and the period of custody undergone by him, we, while setting aside the order dated 22.04.2025 passed by the learned Additional Sessions Judge-I, Seraikella in M.C.R.A. No. 506/2025 in connection with Kuchai P.S. Case No. 33/2019, direct that the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Seraikella in connection with Kuchai P.S. Case No. 33/2019. This appeal is allowed. (Rongon Mukhopadhyay, J.)
