1. Petition under Section 528 of the Bharatiya Nagrik Suraksha Sanhita, 2023 (“BNSS”) has been filed on behalf of the Petitioner for quashing of FIR No.0089/2018 under Sections 354/354(D)/509/341/506 IPC registered at PS: Keshav Puram and all the consequential proceedings emanating therefrom, in terms of MoU/Compromise Deed dated
28.03.2024. 2. Issue Notice. 3. Learned APP for the State and learned counsel for Respondent No.2 appear on advance Notice and accept Notice. 4. As per the allegations made in the FIR, Respondent No.2 was being stooped and harassed by the Petitioner as and when she went to her office. disputes have been amicably settled. 5. The Petitioner has not only apologized to her publically in the Court but also has given an apology by way of affidavit, which has been accepted by Respondent No.2 and has been taken on record. He is will to pay Rs.10,000/- as compensation to Respondent No.2. 6. It is submitted that the FIR was a consequence of the disputes between Respondent No.2 and the Petitioner. On intervention of the relatives, family friends, neighbors, as well as the lawyers, Petitioner and Respondent No. 2 have amicably settled all their disputes and differences between them and arrived at Settlement vide MoU/Compromise Deed dated 28.03.2024. 7. Today, Respondent No. 2 is present in the Court and has been identified by the Investigating Officer. She states that she has received no objection if the FIR in question is quashed. 8. The Statement of the parties have already been recorded before the learned Joint Registrar.
They have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement. 9. Considering the nature of the dispute, which is essentially a neighborhood fight and that they have settled the matter, the FIR No.0089/2018 under Sections 354/354(D)/509/341/506 IPC registered at PS: Keshav Puram and all the consequential proceedings emanating therefrom are quashed. 10. The Petition is disposed of accordingly. Pending Application, if any, also stand disposed of. This is a digitally signed order.
