Nil The Court made the following: ORAL ORDER: Heard Sri P. Narahari Babu, learned Counsel for the Civil Revision Petitioner. 2. It is the submission of the learned Counsel for the Civil Revision Petitioner that the Petitioner filed O.S.No.2 of 2025 on the file of the Civil Judge (Senior Division), Hindupur, seeking family partition. The Petitioner has also filed I.A.No.8 of 2025 seeking a temporary injunction for protection of the Suit Schedule Properties in order to prevent alienation by the Respondents/Defendants and also not to create any third party rights. 3. 4. It is the submission of the learned Counsel for the Civil Revision Petitioner that vide Order dated 08.01.2025, the learned Single Judge (Senior Division), Hindupur was pleased to grant temporary Injunction under Order 39 Rule 1 & 2 of the Code of Civil Procedure. Thereafter, the learned Judge was pleased to dismiss I.A.No.8 of 2025. Vide Order dated 19.03.2025, the Plaintiff challenged the said Order passed in I.A.No.8 of 2025 by filing C.M.A.No.02 of 2025. The Plaintiff also filed I.A.No.52 of 2025 before the Additional District Judge, Hindupur, seeking temporary Injunction. He would submit that the Respondent No.1 therein (Defendant No.1) was on a caveat, therefore, the learned Judge issued Notices to Respondent Nos.2 to 4 (Defendant Nos.2 to 4). 5. 3 6. It is the submission of the learned Counsel for the Civil Revision Petitioner that, instead of passing orders in I.A.No.52 of 2025 in C.M.A.No.02 of 2025, the learned Judge issued notices to Respondent further submitted that there is Nos.2 to 4. It is a likelihood of the Defendants alienating the Suit Schedule Properties during the interregnum in order to defeat the interest of the Petitioner/Plaintiff. 7. Having considered the above facts, this Court is of the view that the interest of justice could be met by giving a direction to the Additional District Judge, Hindupur, to consider and dispose of Interlocutory Application 2025 in accordance with law within Parties are directed to cooperate with the Additional District Judge, Hindupur, for the disposal of I.A.No.52 of 2025 within the time fixed by this Court. 9. With these observations and directions, this Civil disposed of. No order as to costs. Interlocutory Applications, if any, stand closed in terms of this order.
