HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. WRIT PETITION No. - 2342 of 2025 Court No. - 11 HON'BLE ABDUL MOIN, J. HON'BLE MRS. BABITA RANI, J. Counter affidavit filed by learned AGA today is taken on record. Case called out. None appears on behalf of the petitioners to press this petition despite notice having been affixed outside the court for taking up the matter at 2:15 PM. This writ petition has been filed with a prayer to issue a writ, order or direction in the nature of Mandamus commanding the opposite parties no. 2 and 3 to secure/protect the peaceful matrimonial life of petitioners and directing the opposite party no. 4 not to interfere and harass the petitioners' peaceful matrimonial life. By the earlier order of this Court dated 20.3.2025, the protection was granted to the petitioners on account of having got married. Learned AGA, on the basis of averments contained in paragraph 5 of the counter affidavit, states that an FIR dated 18.3.2025 bearing Case Crime No. 0124 of 2025 under Section 87 of BNS, 2023 has been registered against Sonu-petitioner no. 2 (wrongly mentioned as Shanu in the memo of writ petition) and after recording the statement of the victim under Section 183 BNSS, 2023, a final report no. B14/2025 dated 22.3.2025 has been submitted before the supervisory authority, hence, the present petition has become infructuous. Accordingly, the present petition is dismissed as infructuous.
