The petitioner- Narsingh Machhua is in custody since 25.10.2021 in connection with Goilkera P.S. Case No. 37 of 2021 corresponding to N.D.P.S. Case No.01 of 2022 for the offence registered under Sections 20(b)(ii)C and 22(C) of the N.D.P.S. Act pending in the Court of learned Sessions Judge- I, West Singhbhum. Earlier bail application of this petitioner was rejected on merit on 23.08.2023 and the same is being renewed on the ground that the petitioner is languishing in jail custody for more than four years. Learned A.P.P. opposed the prayer for bail. It is submitted that matter involves seizure of 122 Kg. cannabis, which is a commercial quantity for which the sentence that can be imposed under Section 37 of the N.D.P.S. Act, is ten years minimum and twenty years maximum. Further, out of 11 witnesses, five witnesses have been examined. Under the circumstance, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner, is hereby, rejected. (Gautam Kumar Choudhary, J.) Anit
