(ORAL) This petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking anticipatory bail in case bearing FIR No.194 dated 30.06.2019 under Sections 307/365/395 of IPC and Section 25 of Arms Act, registered at Police Station Kasola, District Rewari (Haryana). On 30.01.2025, the following order was passed:- ‘Prayer is for grant of anticipatory bail to the petitioner in criminal case having FIR No.194 dated 30.06.2019 registered under Sections 307, 365, 395 of IPC and Section 25 of Arms Act, 1959 at Police Station Kasola, District Rewari, Haryana.. Counsel for the petitioner inter alia submits that the petitioner is falsely nominated as accused in the present case which was registered against unknown persons who tried to loot a truck driven by complainant Amrik Singh. It is further submitted that co-accused Baghel Singh, who faced trial is acquitted vide judgment dated 18.08.2022 (Annexure P-4) passed by the Court of Additional Sessions Judge, Rewari. Further similarly situated co-accused namely Saddam and Surender have already given concession of anticipatory bail vide orders Annexure P-1 and Annexure P-3. Counsel for the petitioner further submits that petitioner is ready to join investigation with the police and the petitioner is not facing any other criminal case at this point of time. Notice of motion. Mr. Arjun Lakhanpal, Addl.A.G., Haryana accepts notice on behalf of the State and submits that no doubt FIR in this case was registered against unknown persons but later on the present petitioner was nominated as an accused on the basis of disclosure statement suffered by co-accused Baghel Singh and that petitioner is required by the police for the purpose of proper investigation in this case. However, the State counsel has not disputed the fact hat the aforesaid co-accused Baghel Singh is already acquitted by the trial Court vide judgment dated 18.08.2022 (Annexure P-4). Now be listed on 26.05.2025. ’ Learned State counsel on instructions from ASI Pradeep Kumar, at the very outset informs the Court that the petitioner has joined the investigation and his custodial interrogation is not required. In view of the statement of learned State counsel, order dated 30.01.2025 is hereby made absolute. The petitioner shall abide by the terms and conditions envisaged under Section 482(2) of BNSS (earlier Section 438(2) Cr.P.C.). The petition stands disposed of.
