No. - 1279 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. 1.The present anticipatory bail application has been filed seeking anticipatory bail in case crime No.0561 of 2012 under sections 3/5A/8 of U.P. Prevention of Cow Slaughter Act, P.S. Gosaiganj, district Sultanpur. 2.Heard learned counsel for the applicant and learned Additional Government Advocate for the State.In view of the proposed order, notice to respondent No.2 is dispensed with. 3.Learned counsel for the applicant submits that there is no recovery from the applicant. The offences are triable by Magistrate. The applicant has explained criminal history of one case in the bail application. The applicant is entitled to be enlarged on anticipatory bail. 4. Learned Addl. Government Advocate has opposed the prayer made by applicant's counsel. He has drawn attention of the court towards the first information report and submits that from the personal search of the accused applicant, a blood stained knife, two daggers and a wooden stick as well as six quintal of beef were recovered. 5.Considering the above aspects of the matter and perusal of the record, it appears that the applicant along with the co-accused persons have been arrested from the spot, six quintal of beef and the weapons above referred have been recovered, the applicant was caught on the spot, thus it cannot be said that it is a case of false implication or he has been implicated to Versus Counsel for Applicant(s) : Arti Shukla Counsel for Opposite Party(s) : G.A. Mohammad Ahmed @ Kafil @ Mohd. Kafil .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Deptt. Lko. And Another .....Opposite Party(s) injure his reputation.
