2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue for the respondents. 3. The learned counsel for the petitioner submits that the petitioner is the absolute owner and possessor of the land admeasuring to an extent of 15 gadies or equal to Ac.0.02 cents approximately in Sy.No.354/1A of Koppolu Revenue Village, Ongole Mandal, Prakasam District. The said land was
4
acquired by the petitioner through a registered sale deed, and, pursuant thereto, the petitioner's name was duly mutated in the revenue records. Subsequently, when the petitioner approached the 5th respondent seeking conveyance of the subject property in favour of third parties, the petitioner was informed that the property had been enlisted in the prohibitory register. In response, the petitioner submitted a representation dated 08.01.2024, requesting deletion of the subject property from the list of prohibited properties. However, no action has been taken by the respondents on the said representation till date. Hence, the Writ Petition. 4.
On the other hand, the learned Assistant Government Pleader appearing for the respondents has furnished a copy of written instructions issued by the 4th respondent dated 07.07.2025, wherein, the relevant portion is extracted hereunder:
“Further, the petitioner has submitted an application dated 31.12.2024 through Meeseva services bearing No.TTA012400125569 requesting deletion of the said property from the list of prohibited properties under Section 22-A(1)(a) of the Registration Act, 1908. Since the land in question is identified as originally assigned and the transfer is not in accordance with the law, the deletion from the 22-A list requires detailed verification and decision by the District Level Screening Committee (DLSC), chaired by the District Collector. In view of the above facts, it is submitted that the deletion of the subject land from the 22-A prohibited property register can be considered or rejected only based on the decision of the DLSC. Hence,
5
this office will forward necessary proposals to the District Collector, Prakasam, for placing the matter before the DLSC for appropriate action as per rules in force.”
5. Having regard to the submissions of the learned counsel for the petitioner, the learned Assistant Government Pleader for the Revenue and on perusal of the material available on record, this Court is of the considered view that the present Writ Petition can be disposed of directing the respondents to consider the representation dated 08.01.2024 filed by the petitioner, after providing opportunity of hearing to the parties concerned, within a period of four (04) months from the date of receipt of a copy of this
order.
6. In the result, the Writ Petition is disposed of. There shall be no order as to costs.
Consequently, Miscellaneous Petitions, if any, pending in the Writ Petition shall stand closed.
