By this petition under Section 483 BNSS, 2023 the accused-petitioners, namely, (i) Shamim Ahmed Laskar @ Samim Ahmed Laskar (ii) Salim Ahmed Laskar, who were arrested on 11.08.2025 in connection with Silchar PS Case No. 806/2025 under Sections 61(2)/112(2)/316(2)/318(4) BNS read with Section 10 of The Public Examination (Prevention of Unfair Means), Act, 2024. 3. It is submitted that FSL report has not yet been received. It appears that previously the prosecution was granted time to submit the FSL report. The allegation against the accused is that he carried a mobile phone inside the examination hall when examination for the post of Block Accountant was being conducted by ASLRMS on 10.08.2025. The accused was arrested on 11.08.2025 and the FIR was lodged by the Principal of the Institution. Although there appears to be incriminating material against the accused persons in the CD, having regard to the nature of the allegations and the period of detention of 35 days, the prayer for bail is allowed. Accordingly, it is provided that the accused petitioners, named above, shall be allowed to go on bail of Rs. 50,000/- (Rupees Fifty Thousand) only with two sureties of the like amount in connection with the aforesaid case subject to the satisfaction of CJM, Cachar, Silchar. 5.
