Applicants have approached this Court through this application under Section 528 B.N.S.S. for quashing of the entire proceedings of Case No.85919 of 2024, State Versus Girish Padey and others, arising out of Case Crime No.23 of 2024, under Sections 420, 406, 323, 147, 427, 506, 507, 120-B I.P.C., registered at Police Station Gosaiganj, district Lucknow, pending before Additional Chief Judicial Magistrate VI, Lucknow. Compromise relied upon by the applicant is partial as the complainant has compromised the offences in respect of the two accused persons (applicants), whereas through the impugned charge sheet four accused persons have been sent to face trial. Even otherwise, the alleged offence are compoundable and the applicant can also avail the alternative remedy before the trial court, therefore, this Court is not inclined to exercise inherent powers under 528 B.N.S.S. The application is disposed of with liberty to the applicants to avail alternative statutory remedy. Office is directed to return the copy of compromise, if any, to learned counsel for the applicants.
