Heard learned counsel for the parties. 2.Upon hearing learned counsel appearing on behalf of the petitioner, State and the Executive Engineer, Jal Nigam, District Pratapgarh, we are of the view that the water tank is being built on Gata No.81 and the petitioner has apprehension that while building of the said water tank, his property which is in Gata No.80 may be encroached. 3. In light of the above, we are of the view that the authority should ensure that they do not encroach upon the land belonging to the petitioner and the petitioner shall be at liberty to make an application for demarcation in accordance with law. 4. With the above, the writ petition is disposed of.
