Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record. 2. On 11.12.2025, the following order was passed : "1. Hard copy of the petition placed before this Court by the applicant's counsel is taken on record. 2. List this case on 16.12.2025 at 11:30 am alongwith Application u/s 482 No. 3862 of 2024. 3. On the next date, the victim- Kalpana Gautam, w/o Mukesh Kumar Gautam, r/o 428, Kanchanpur, Matiyari Chauraha Deva Road, Tempo Bus Stand, P.S. Chinhat, Lucknow and respondent no.2- Mukesh Kumar Gautam, s/o Sri Ram, r/o Azad Nagar, Chillawan, Amausi Airport, P.S.- Sarojini Nagar, Lucknow, shall appear in person before this Court. 4. Station House Officer, Police Station- Sarojini Nagar, Lucknow shall ensure the presence of Mukesh Kumar Gautam before this Court on the next date." 3. As the present petition is filed by the informant, who is mother of Kalpana Gautam, The marriage of Kalpana Gautam was solemnised with Mukesh Kumar Gautam-respondent no.2.. 4. In pursuance of the aforesaid order, Kalpana Gautam, wife of Mukesh Kumar Gautam, daughter of Sri Ramesh Gautam, R/o 428, Kanchanpur, Matiyari Chauraha Deva Road, Tempo Bus Stand, P.S. Chinhat, Lucknow having Aadhar Card No.731484024853 and private respondent no.2 Mukesh Versus Counsel for Applicant(s) : Aiyyaz Mansuri, Mohd Siraj Counsel for Opposite Party(s) : G.A. Smt. Maya Devi .....Applicant(s) State Of U.P. Through Principal Secretary Home And 2 Others .....Opposite Party(s) Kumar Gautam, Son of Sri Ram, R/o Azad Nagar, Manas Nagar, along with Sub Inspector, Sri Hariom Singh, P.S. Sarojini Nagar, Lucknow are present before this court. 5. The aforesaid Kalpana Gautam has categorically denied to join association of her husband and also stated that she is not being maintained by her husband in proper manner. The charge sheet was submitted in the crime in question and the case is registered as criminal case no.48070 of 2023, therefore, this court of the view that there is no urgency.
