The petitioner has been made accused in connection with N.D.P.S. Case No. 15 of 2021 arising out of Balumath P.S. Case No. 178 of 2021, for the offences registered under Sections 15(c), 18(b) & 22(c) of the NDPS Act, pending in the Court of learned Sessions Judge-cum-Special Judge, Latehar. 3. Bail Application of the petitioner was earlier rejected by a Co-ordinate Bench of this Court vide B.A. No. 9882 of 2022 by order dated 10.02.2023. 4. On 26.08.2021, at about 04:30 A.M., Balumath Police intercepted a truck bearing Registration No. UP76K-7033 and on search, 594 Kgs. of poppy husks were recovered from the said truck. The driver and cleaner of the truck were apprehended. 5. It was submitted that name of the petitioner has come in the confession of apprehended co-accused persons. It was further submitted that the petitioner was neither apprehended at the spot, nor anything was recovered from his possession. 6. In view of the submissions made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Sessions Judge-cum-Special Judge, Lateharin connection with N.D.P.S.
