HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 1574 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Heard learned counsel for the applicant, learned AGA and perused the record. Sri Abhishek Awasthi appears for the informant.
2. This is second application for bail seeking enlargement in ST No.2055 of 2022 arising out of FIR/Case Crime No.130 of 2022 under sections 498-A, 304-B IPC and section 3/4 DP Act, P.S. Jankipuram District Lucknow. The first application for bail of the accused was rejected on 30.11.2023 and directions were issued for conclusion of the trial within a period of one year.
3. It is argued that the criminal trial has not concluded and the trail is at the stage of defense evidence. The applicant is in custody since 13.04.2022 and has no criminal history.
4. Considering the substantial pretrial detention suffered by the applicant coupled with the fact that all the fact witnesses of the prosecution have already been recorded and there is nothing on record to demonstrate that the applicant if enlarged on bail can have any adverse affect on the trial, the applicant who is in custody since 13.04.2022 is entitled for the bail. Thus the bail application is allowed.
