SUNIL DUTT YADAV ORAL ORDER The petitioner has sought for issuance of writ in the nature of mandamus directing the respondents to issue occupancy certificate to the petitioner as sought for in the applications dated 31.07.2023 (Annexure-R) and 28.08.2024 (Annexure-S). 2. During the pendency of the present proceedings, learned counsel for respondents 1 and 3 had filed memo dated 07.04.2025 along with endorsement dated 21.08.2023. It is submitted that the issuance of occupancy certificate would be considered by the respondents, subject to fulfillment of the condition stipulated in the endorsement dated 21.08.2023 and - 3 - NC: 2025:KHC:14628 WP NO.6071 OF 2025 furnishing of relevant documents. Learned counsel for the petitioner filed memo and submits that the documents as sought for in the aforesaid endorsement have been furnished to the respondent-Authorities. Further, learned counsel for the petitioner submitted that there has to be a renewal of building licence after rectifying the building licence it is to be issued for the residential property and, such process of rectification is still pending in the hands of the respondents. - 4 - NC: 2025:KHC:14628 WP NO.6071 OF 2025 4. Learned counsel for the respondents 1 and 3 submit that the respondents would examine such aspect and take decision regarding same. 5. Accordingly, Writ Petition is disposed of. Respondents 1 and 3 are directed to take note of the documents now furnished by the petitioner before the respondent No.1 as indicated in the memo dated 07.04.2025 filed before this Court and also to examine the request of the petitioner for issuance of rectified renewal of building licence and also consider the request of the petitioner for issuance of occupancy certificate in terms of the applicable procedure as per law. 6. Once, the petitioner furnishes all necessary documents as sought for by the respondent No.1 and satisfies the clarification sought for by the respondent No.1 in relation to relief sought for at applications dated 31.07.2023 and 28.08.2024 produced at Annexures 'R' and 'S' respectively, respondents 1 and 3 shall consider the same and pass orders as expeditiously as possible in any event, within an outer limit of one month thereafter.
