Hemchandra, learned Sr. counsel assisted by Mr. Rendy M., learned counsel appearing for the petitioner; Mr. Shyam Sharma, learned GA appearing for the respondent nos. 1 to 5; and Mr. S. Suresh, learned counsel appearing for the respondents no. 6. [2] At the outset, it has been submitted by the learned Sr. counsel appearing for the petitioner that the petitioner is going to retire from service w.e.f. 28.02.2026 on attaining the age of superannuation and as such, it has been submitted by the learned Sr. counsel that instead of deciding the present writ petition on its own merit by this Court the petitioner will be satisfied for the time KABORA MBAM SAPANA CHANU Digitally signed by KABORAMBAM SAPANA CHANU Date: 2026.01.16 13:27:55 +05'30' Page 2 being if the present writ petition is disposed of by directing the Commissioner (RD&PR)/ Vice-Chairman, AC/GB of SIRD, Manipur to consider the representations dated 15.09.2025 & 24.11.2025 submitted by the petitioner on its own merit and strictly in terms of applicable rules and to disposed of the same by issuing a speaking order on or before the date of the petitioners’ retirement. [3] Mr. Shyam Sharma, learned GA appearing for the State respondent and Mr. S. Suresh, learned counsel appearing for the Accountant General submitted that as the prayer made on behalf of the petitioner is confined to consideration and disposal of the representation submitted by the petitioner, they have no objection in disposing of this writ petition as prayed for on behalf of the petitioner. [4] Considering the submission advanced by the learned counsel appearing for the parties, this Court is of the consider view that it will be in the interest of justice to issue the following directions; (i) The Commissioner (RD&PR)/ Vice-Chairman, AC/GB of SIRD, Manipur is hereby directed to consider the representations dated 15.09.2025 Page 3 and 224.11.2025 submitted by the petitioner on its own merit and strictly in terms of the applicable rules and to dispose of the same by issuing a speaking order. (ii) The whole exercise should be completed as early as possible but not later than 28.02.2026. (iii) The Respondent no. 2 i.e. Commissioner (RD&PR) is also directed to communicate the order passed by him in connection with the aforesaid representation to the petitioner as early as possible. (iv) It is also made clear that the aforesaid direction has been issued by this Court without considering the merit of the present writ petition.
