HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 7467/2025 Munni Devi W/o Late Sh. Late Sh Mahaveer Lal Jain, Aged About 67 Years, Resident Of Kafla Bazar, Tehsil And District Tonk, Rajasthan. ----Petitioner Versus Nitesh Changani Son Of Sh Harsih Kumar Changani, Aged About 32 Years, Resident Of Near Patwar Training Centre, Civil Lines, Tonk Tehsil And District Tonk, Commercial Address Arihant Complex, Shagarid Pesha, Bada Kuwan, Tonk, Tehsil And District Tonk Rajasthan. ----Respondent For Petitioner(s) : Mr. Vikas Kabra For Respondent(s) : JUSTICE ANOOP KUMAR DHAND Order 20/05/2025 1. By way of filing this writ petition, a prayer has been made for issuing directions to the Rent Tribunal, Tonk to decide the eviction application No.07/2024 within a period of six months. 2. Learned counsel for the petitioner submits that the petitioner is a widow lady of the age of 66 years and she has filed an application under Section 9 of the Rajasthan Rent Control Act, 2001 for eviction of the respondent. Counsel submits that the said application is lying pending for its adjudication, so appropriate directions be issued to the Tribunal to decide the said application expeditiously within a period of six months. (2 of 2) [CW-7467/2025] 3. Heard and considered the submissions made at the Bar and perused the material available on the record. 4. Perusal of the record indicates that the eviction application has been preferred by the petitioner on 06.04.2024. 5. The Hon’ble Apex Court in the case of High Court Bar Association, Allahabad vs. State of Uttar Pradesh, while deciding the Criminal Appeal No.3589/2023 has deprecated the practice of the Courts of issuing directions to the subordinate Courts to decide the matter in a timeline. 6. In the instant case, hardly one year has passed and the petitioner has approached this Court seeking aforesaid directions. 7. The aforesaid directions cannot be issued by this Court. But looking to the fact that the petitioner is a widow lady, it is expected from the Rent Tribunal to make all possible endeavours to decide the eviction application expeditiously. 8. With the aforesaid observations/directions, the instant writ petition stands disposed of. Pending applications, if any, also stand disposed of. (ANOOP KUMAR DHAND),J KuD/89
