A preliminary objection has been raised on behalf of counsel for the respondent no. 3 that against the order impugned, statutory alternative remedy is available to the petitioner to file a revision under sub-Section (3) of Section 41 of the U.P. Urban Planning and Development Act, 1973. In view of the aforesaid, it is argued that writ petition is liable to be dismissed on the ground of statutory alternative remedy. 3. Since nobody is present on behalf of petitioner, the writ petition is dismissed for non prosecution.
