No.24/2024, dated 12.02.2024, registered at Police Station, Dharampur, District Mandi for the commission of offences punishable under Sections 353, 504 & 506 of Indian Penal Code (IPC) and consequential proceedings arising out of 1 Whether the reporters of the local papers may be allowed to see the Judgment?Yes. 2 ( 2025:HHC:28889 ) the same pending before learned Judicial Magistrate First Class, Dharampur, District Mandi, Himachal Pradesh. 2. It has been asserted that the petitioner and the informant have compromised the matter with the intervention of the respectable persons of the society and their close friends. The victim does not wish to proceed further with the matter due to the compromise. Hence, the petition. 3. Statements of informant Ram Veer Meena and victim Naresh Kumar Meena were recorded on 14.07.2025, in which they stated that the matter has been compromised between the parties voluntarily without any influence from any person. They do not wish to proceed further with the matter because of the compromise. 4. I have heard learned counsel for the parties and have gone through the records meticulously. 5. The offences punishable under Sections 504 and 506 of the IPC are compoundable under Section 320 of the Cr.PC. This Court has already quashed the proceedings under Section 353 IPC, inter alia, in Sumit Kumar Vs. State of H.P. (2020) SCC Online HP 436, Sections 323, 353 and 506 of IPC in Murari Lal Vs. State of H.P. (2023) HHC 628, and Sections 341 and 353 of
3 ( 2025:HHC:28889 ) IPC in Rakesh Kumar and another Vs. State of H.P., Cr.MMO No. 700 of 2019, decided on 1.1.2020. These judgments are binding upon this Court. 6.
In view of the binding precedents of this Court, the present petition is allowed and the F.I.R. No.24/2024, dated 12.02.2024, registered at Police Station, Dharampur, District Mandi for the commission of offences punishable under Sections 353, 504 & 506 of Indian Penal Code (IPC) and consequent proceedings arising out of the FIR are quashed. 7. Petition stands disposed of in the above terms, so also pending applications, if any. 8. Parties are permitted to produce a copy of this judgment, downloaded from the webpage of the High Court of Himachal Pradesh, before the authorities concerned, and the said authorities shall not insist on the production of a certified copy, but if required, may verify passing of the order from the Website of the High Court.
