Neutral Citation No. - 2025:AHC:31447 Court No. - 7 Case :- WRIT - C No. - 4609 of 2025 Petitioner :- Veerendra Pratap Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Amar Singh Yadav Counsel for Respondent :- Bhupendra Kumar Tripathi,C.S.C. Hon'ble Prakash Padia,J. 1. Heard learned counsel for the petitioner and perused the record. 2. In view of the order proposed to be passed herein, no useful purpose would be served by putting the opposite party to notice and keeping this petition pending before this Court. However, in case the opposite party feels aggrieved by the order his/her right to seek modification/variation of the order is being kept reserved. 3. The petitioner has preferred the present petition inter alia with the following prayer:- "i) issue a writ, order or direction in the nature of mandamus directing the respondent authorities not to raised the constructions of chak marg from the petitioner's Arazi No. 152 and 154 situated in Village Sukarnakala, Post Usrauli, Tehsil Shahganj, District Jaunpur. ii) issue a writ, order or direction in the nature of mandamus directing the respondent no. 2 to take necessary action on the application Under Section 26 of U.P. Revenue Code, 2006 of petitioner dated 21.01.2025 within stipulated period which is pending before the respondent no. 2 (Annexure No. 3 to this writ petition)." 4. It is argued that though the application under section 26 of the U.P. Revenue Code, 2006 was filed by the petitioner before the respondent no. 2 on 21.01.2025 but till date no decision has been taken in the same hence the present petition. 5. On the other hand, it is argued by learned counsel for respondent No 2 as well as learned Standing Counsel that the respondent no. 2 will take decision in the matter expeditiously. 6. In the facts and circumstances of the case, the present petition is disposed of directing the respondent no. 2 to pass appropriate orders the aforesaid application dated 21.01.2025 strictly in accordance with law most expeditiously and preferably within a period of four weeks from the date of production of certified copy of this order unless there is no legal impediment.
