Heard Sri Ambrish Singh Yadav, learned counsel for the applicant, learned AGA for the State, Sri Sri Vijay Kumar, learned counsel for opposite party no.2 and perused the record. 2. This application has been filed for quashing the entire proceedings of the private Complaint no.7870 of 2021 (Adarsh Mishra vs. Vikash Yadav and another) pending in the court of Chief Judicial Magistrate, Hardoi, as well as impugned cognizance and summoning order dated 8.11.2021 passed by the Chief Judicial Magistrate, Hardoi whereby the applicant has been summoned under Sections 323, 504 and 506 IPC. 3. Learned counsel for the applicant after arguing at some length submits that he does not want to press this application on merits. However, he submits that he would like to file an application for discharge under the provisions of Cr.P.C., to which learned counsel for the State and learned counsel for opposite party no.2, do not have any objection. 4. Accordingly, the applicant is granted liberty to file an application for discharge in conformity with the provisions of Cr.P.C., within a period of two weeks from today. After the said application is filed, learned trial court is directed to dispose of the same within a period of four weeks thereafter. The applicant is also granted liberty to appear through his counsel.
