This is the second bail application of the applicant. The first bail application of the applicant has been dismissed as withdrawn on 21.11.2024 passed in MCRC No. 7095/ 2024. It transpires that while withdrawing the bail application, no liberty was granted in favour of the applicant. 2. Learned counsel for the applicant would submit that in the present case total 16 witnesses have been cited, out of which 7 witnesses have been 2 examined. The applicant is in jail since 23.06.2024 and final adjudication of the case will take its own time, therefore, he has filed the second bail application. 3. On the other hand, learned counsel for the State opposes the submission made by learned counsel for the applicant. 4. Considering the submissions made by learned counsel for the parties, considering that there is no liberty granted in favour of the applicant while first bail application has been dismissed as withdrawn, merely examining some of the witnesses does not amounts to change in circumstances, further that the trial of the case is going on and 07 witnesses have been examined, I do not find any good ground to admit the second bail applicant of the applicant. 5. Accordingly, the second bail application filed by the applicant is dismissed at the motion stage itself.
