CRLMC No. 1196 of 2025
Santosh Das & Ors. …. Petitioner(s) Mr. S. Kar, Advocate
-versus- State of Odisha …. Opposite Party (s) Mr. B. Nayak, AGA
CORAM:
JUSTICE SIBO SANKAR MISHRA
Order No.
ORDER 03.04.2025
01.
1. Heard.
2. The petitioners are seeking quashing of the entire criminal prosecution initiated against them in connection with Jharpokharia P.S. Case No.253 of 2022 corresponding to G.R. Case No. 99 of 2022 pending in the court of the learned 1st Additional Sessions Judge- cum- Special Judge, Baripada on various grounds.
3. I am not inclined to entertain this petition at this stage because out of seven charge sheeted witnesses, three witnesses have already been examined and the trial is at an advance stage. Therefore, while exercising the jurisdiction under Section 482 Cr.P.C., p. 2 this Court is not inclined to scuttle the trial abruptly when the trial is proceeding at an expected pace. Hence, the petition is dismissed. However, liberty is granted to the petitioners to urge all the points before the court below at the appropriate stage.
