Sharma, learned Jr. Government Advocate for the respondents No.1, 3, 4 and 5; Mr. R Boro, learned counsel for the respondent No. 2 and Mr. A.R. Sikdar, learned counsel for the respondent No. 7. In view of the averments made in the affidavit filed by the State that the certificate enclosed by the writ petitioner at Annexure-1, Page-18 of the Muslim Marriages and Divorces Registrar and Kazi, Goroimari, Kamrup certifying that the petitioner and late Soleman Khandaker were married and the marriage was
Page No.# 3/3 solemnized on 20.03.1995 could not be verified from the concerned Officer which prima facie raises a question as to the authenticity of the said certificate, the learned counsel for the petitioner after submitting at some length before the Court craves liberty of the Court to withdraw the writ petition to pursue his remedy before an appropriate forum namely the Civil Court. In view of such prayer made without expressing anything on merit, the writ petition stands dismissed with liberty to the petitioner to approach appropriate Civil Court of competent jurisdiction to pursue his claim. Interim order if any stands vacated. Pending I.A is any are also dismissed.
