This petition has been filed with the following main prayer :- "To issue a writ, order or direction in the nature of mandamus commanding the respondent no.3 – Principal, U.P. Sports College, Kursi Road, Lucknow to make payment of Rs.2,02,389/- to each petitioner in pursuance of award dated 22.09.2021 passed by Presiding Officer, Labour Court, U.P. Lucknow in Adjudication Dispute Case no.65 of 2000 forthwith." Shri Ashutosh Shahi, Advocate has filed his power on behalf of respondent no.3. He has raised a preliminary objection regarding maintainability of the writ petition. He says that notice in an application under Section 6 (N) of the U.P. Industrial Disputes Act is pending before the Labour Court and simultaneously this writ petition has been filed. This writ petition is disposed of with a direction to the petitioner to pursue their remedy under Section 6 (N) of the U.P. Industrial Disputes Act, 1947 before the court concerned where it is stated to be pending.
