Heard the learned counsels for the parties. 3. FIR in Crime No.515/2024 was registered by Hiriyur Rural Police Station, Chitradurga, for the aforesaid offences against the petitioner and three others on the basis of the first information dated 09.12.2024 received from the victim lady aged about 29 years. Apprehending arrest in the said case, petitioner had filed Crl.Misc.No.1615/2024 before the Jurisdictional Sessions Court which was rejected on 17.01.2025. Therefore, the petitioner is before this Court. 4. Learned counsel for the petitioner having reiterated the grounds urged in the petition prays to allow the petition. - 3 - NC: 2025:KHC:13038 CRL.P No. 2632 of 2025 5. Per contra, learned High Court Government Pleader has opposed the petition. 6. Perusal of the material on record would go to show that victim lady is aged about 29 years and petitioner is aged about 31 years. In the first information, it is stated that petitioner and the victim girl are acquainted to each other and for the last nearly 10 years they are in love with each other. It is alleged that petitioner had promised to marry the victim lady, had sexual intercourse with her and he also had taken certain cash and gold jewellary from the victim lady. It is further alleged that in the month of October-2024, when the victim lady asked the petitioner to marry her, he allegedly informed her that, he is already married and it is under these circumstances, she has approached the police. Petitioner and the victim lady appears to be having relationship for the last nearly 10 years. It is only after the relationship has failed, the victim lady has approached the police. Considering the aforesaid aspects of the matter and the nature of allegations found in the first information, I am of the opinion that the prayer made by the petitioner, who has no other criminal - 4 - NC: 2025:KHC:13038 CRL.P No. 2632 of 2025 antecedents for grant of anticipatory bail is required to be answered affirmatively. Accordingly, the following:- ORDER The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.515/2024 registered by Hiriyur Rural Police Station, Chitradurga, for offences punishable under Sections 118(1), 3(5), 352, 69 of BNS, subject to the following conditions: 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3.
