GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action of the Respondents in not registering and investigating the Petitioner's complaint dt.28.08.2020 and 30.08.2020 as illegal, arbitrary and violation 2 of fundamental rights and Consequently direct the Respondents or any other investigating Agency to register and investigate the complaints dt.28.08.2020 and 30.08.2020….” 2. Sri Md.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, previously, based on the complaint of the Petitioner, a case in Crime No.12 of 2020 of Women (Disha) Police Station was registered for the offences under Sections 498-A and 354-A IPC and Sections 3 and 4 of the Dowry Prohibition Act. It is further submitted that, subsequently, the Petitioner filed complaints dated 28.08.2020 and 30.08.2020 and on receipt of the said complaints, having found that the contents of the complaints disclose the offence under Section 506 IPC, which is a non-cognizable offence, the Petitioner was advised to approach the competent Court as an alternative statutory remedy available. based on the complaint given by the Petitioner, a case in Crime No.60 of 2020 3. Sri D.Anil Kumar, learned counsel for the Petitioner would submit the Court may pass appropriate orders. 4. Considering the submissions made, the Writ Petition is disposed of giving liberty to the Petitioner to work out her remedies before appropriate forum in accordance with law. There shall be no order as to costs.
