Heard Shri Ram Kumar Singh, learned counsel for the applicant, Shri S.K. Tiwari, learned A.G.A. for the State and perused the record. The instant application has been filed seeking following main relief(s) :- "Wherefore it is most respectfully prayed that this Hon'ble Court may graciously be pleased to direct the learned court of Special Judge SC/ST Act Hardoi to provide proper opportunity to cross examine the prosecution witness PW-1 for fair trial of the case S.T. No. 83 of 2008, Crime No. 49 of 2005, under section 147, 148, 302, 323, 504, 506 1.P.C. and section 3(2)(v) SC/ST Act. Police Station Atrauli, District Hardoi; State versus Chandra Prakash and others. It is further prayed that this Hon'ble Court may graciously be pleased to exercise supervisory jurisdiction by issuing appropriate direction to learned trial court for fair trial of the case as S.T. No. 83 of 2008, Crime No. 49 of 2005, under section 147, 148, 302, 323, 504, 506 1.P.C. and section 3(2)(v) SC/ST Act, Police Station Atrauli, District Hardoi; State versus Chandra Prakash and others." Learned counsel for the applicant, after arguing at some length states that he may be permitted to withdraw the application with liberty to the applicant to file afresh as and when the cause so arises. The aforesaid has not been opposed. In view of the above, the instant application is dismissed as withdrawn with liberty as prayed for. Office is directed to return certified/original copies of the documents annexed with the application to the learned counsel for the applicant as per rules.
