JUSTICE PRAVEER BHATNAGAR Order 09/05/2025 1. The instant second bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.09/2025 registered at Police Station Special Police Station (SOG), District ATS and SOG for the offence(s) under Sections 420, 467, 468, 471 and 120-B of IPC and Sections 3, 4, 6, 2(F)(ii) and 10 of Rajasthan Public Examination (Measures For Prevention of Unfair Means In Recruitment) Act, 2022. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that the accused-petitioner is in custody since 30.01.2025 and trial of the case may take considerable time., therefore, the second bail application of the accused-petitioner may be allowed. [2025:RJ-JP:19602] (2 of 3) [CRLMB-6144/2025] 3. Learned Public Prosecutor has vehemently opposed the bail application and contended that the accused-petitioner appeared in examination conducted by the Rajasthan High Court for the post of Junior Judicial Assistant Examination Grade-II on 12.03.2023 and 19.03.2023. The schedule of the examination was 12:00 PM to 02:00 PM. The petitioner in her examination form filled her mobile No. as 6376043684, after investigation, it was found that the said mobile number was registered to Om Prakash S/o Dungarram, R/o Sudsar, Dungargarh, District Bikaner. On the date of examination i.e. 19.03.2023 during examination period, the tower location of the said mobile number was found near to the examination center at Udairamsir, Bikaner. It is also contended that during the examination period from 12:00PM to 02:00 PM, the petitioner was in contact with some other persons through mobile Nos. 8306015806 and 8529287720 from 11:51:37 AM for approx 6067 seconds. The tower location of mobile No.8306015806 during examination period was also found at Udairamsir, Bikaner. The investigation also revealed that the mobile No.8306015806 was issued just four days prior to the examination in the name of the petitioner. The petitioner was getting all inputs in the examination center through Bluetooth device and got selected in the examination. In the charge-sheet, the specific allegation containing latitude and longitude of the petitioner's mobile number and the mobile number through which she was getting all inputs regarding the paper in examination hall was also taken by the investigating agency. It was also revealed that co-accused Porav Kaler, who is the king pin of the entire [2025:RJ-JP:19602] (3 of 3) [CRLMB-6144/2025] cheating gang, received Rs.8,00,000/- from the petitioner. Therefore, from the evidence collected so far, it is apparent that the petitioner was found to be involved in cheating and got selected in the said examination. It is also contended that the police after thorough investigation found that the candidates from a particular region and village were selected in the said examination and they were involved in cheating, therefore, considering the above facts, the second bail application of the accused-petitioner may be dismissed. 4. Heard and perused the material available on record. 5. The police in the charge-sheet has specifically assigned the role of the petitioner, containing the mobile location of the petitioner and the mobile location of the other co-accused person, who were involved in facilitating the petitioner in the examination. The petitioner in her examination form filled her mobile number as 6376043684, later on the petitioner applied for another sim and the CAF Id collected during investigation indicates that the said mobile number 8306015806 was issued in the name of the petitioner. The said mobile numbers were used for the purpose of cheating in the examination, therefore, this Court is not inclined to enlarge the accused-petitioner on bail. 6. Hence, the second bail application of the accused-petitioner is hereby, dismissed. (PRAVEER BHATNAGAR),J Keshav/4
