NO. 202/2014 AND HANDOVER THE INVESTIGATION EITHER TO AN OFFICER OF THE RANK NOT BELOW THE RANK OF SUPERINTENDENT OF POLICE OR TO THE SPECIALIZED AGENCY SUCH AS COD OR CID AND TO FILE REPORT AND ETC. THIS WRIT PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioner is before this Court seeking for the following reliefs: i. To issue a writ in the nature of mandamus directing the R1 to divest R3 and R4 from investigation in respect of Cr.No.202/2014 and handover the investigation either to an officer of the Rank not below the rank of Superintendent of Police or to the Specialized Agency such as COD or CID and to file Report. ii. Issue a writ in the nature of mandamus, directing the Respondents to conduct investigation into the Complaint filed by the Petitioner registered as Cr.No.17/2014 and to file an appropriate report within a time as may be fixed by this Hon’ble Court. iii. Pass such other order or orders as this Hon’ble Court deems fit to grant under the facts and circumstances of the case, in the interest of justice and equity. - 3 - NC: 2025:KHC:16588 WP No. 27290 of 2015 2. During the pendency of the above matter investigation has been completed and B-Final report has been submitted before the Magistrate concerned. 3. The submission of Sri.R.Bhadrinath., learned counsel for the petitioner is that the investigation has not been carried out properly and the matter would have to re-investigated by Specialized agency such as COD or CID. 4. Learned AGA submits that in the present case the investigation has been carried out by CID, as sought for by the petitioner and directed by this Court in pursuance of prayer (1) to the petition. 5. Sri.R.Bhadrinath., learned counsel for the petitioner now submits that the investigation by CID has not been carried out properly and the matter would have to be referred to the CBI. 6. The submission of Sri.R.Bhadrinath., learned counsel for the petitioner could have been considered if the investigation had not been completed, now that the investigation has been completed and B-final report has been placed before the learned Magistrate. It is - 4 - NC: 2025:KHC:16588 WP No. 27290 of 2015 for the learned Magistrate to consider any protest memo filed by the petitioner as regards the B-Final report and pass necessary orders thereon, taking into consideration the submission of learned counsel for the petitioner as to whether the investigation has been carried out properly or not, as also to consider whether reinvestigation would have to be carried out by any other agency/authority. 7. In that view of the matter, I pass the following; ORDER i. The writ petition is disposed of. ii. Liberty is reserved to the petitioner to file a protest memo as regards the B-Final report, which the learned counsel for the petitioner would submits would be filed within 15 days from today. iii. In the event of such a protest memo being filed, learned Magistrate is directed consider the same and pass necessary orders within 30 days thereafter.
